Terms and Conditions of Service

Service Delivery Policy

Consultancy services are delivered subject to a Services and Confidentiality Agreement specifically detailing services, price and delivery details.

On-line intelligence reports ‘Disclosure’ and other publications are delivered by electronic mail to the address submitted to The Cavell Group, unless a special request is authorized and acknowledged by The Cavell Group in advance. Payment is made on-line in advance using an ANZ internet link or by invoice (if requested). Payment receipts and service acknowledgments shall be sent upon transaction completion and subscription of report dispatch activated within 7 days. Annual subscriptions to the ‘Disclosure’ intelligence report and similar products will normally include 10 disseminated reports per annual subscription, usually disseminated every 5 weeks on or around the second week of the month.  All products are subject to legal notices, disclaimers and the terms and conditions outlined.

Training and workshops are subject to specific conditions and cancellation policies, as outlined.

Returned Merchandise and Refund Policy

Subscriptions can be cancelled at any time in the first 14 days thereafter the subscriptions term expires on the annual renewal date. The Cavell Group reserves the right to deduct disseminated report costs where appropriate and a further administration fee of 10% of the total subscription fee.

Workshops

The Cavell Group reserves the express right to cancel seminars, refuse attendance or change venue details, timings and dates, subject to the opportunity of a full refund.

Seminars must be paid in full and cancellation details and charges are as followed:

Cancellation charges are as follows: 31-60 days before commencement - 25% of course fee; 14-30 days before commencement - 55% of course fee; 0-14 days -100% of course fee.

Substitute participants may, however, be accepted at any time, subject to these conditions.

Training Programs

The Cavell Group reserves the express right to cancel training programs, refuse attendance or change venue details, timings and dates, subject to the opportunity of a full refund.

Training programs must be paid in full and cancellation details and charges are as followed:

Cancellations must be made at least 60 days before course commencement to prevent fees. 

31-60 days before commencement - 45% of course fee; 14-30 days before commencement - 85% of course fee; 0-14 days before commencement -100% of course fee

Substitute participants may, however, be accepted at any time, subject to these conditions.

In case of operational necessity or force majeure, we reserve the right to cancel any course at any time and will refund the full course fee.

Training program prices are per participant and include comfortable but basic field-style accommodation, all meals, all approved airport and training location transfers, all training and information session course materials, access to all special equipment and a certificate of attendance and course photographs.

Excluded - Travel costs, taxes and associated insurance.

Participants shall be required to sign medical and confidentiality disclaimers and provide emergency contact details.

Training Programs, Workshops, Products and Services Disclaimer

The Cavell Groups’ training workshops, programs, products and services have been formulated from a range of research and open source intelligence. Except as permitted under the principles of “fair use” no part of such training, product or service may be reproduced in any form, stored in a database or distributed in any form by any means, mechanical or electronic, without the prior written permission of the Cavell Group.

Although great care has been taken in the formulation of all training, products and services, its content in total or any part, the information, service, product or intelligence analysis, the fluid nature of our work and the regions with which information is collated, and the integrity of some local information preclude us from guaranteeing its accuracy. The Cavell Group and all its agents will not be responsible for any errors or omissions or for any loss or damage suffered by any persons as a result of any information written or implied by any agent, instructor, consultant or operative of the Cavell Group.
 
All information is harvested and supplied ‘as is’ with no guarantee of completeness, accuracy or timeliness or of the results associated from the use of this information, and without warranty of any kind whether express or implied, including but not limited to fitness for a particular purpose, non infringement, and security.

These terms and conditions have been construed and shall be governed in accordance with the laws of Australia. Any dispute arising shall be subject to the exclusive jurisdiction of the courts of Australia.

Services

Certain services may be subject to restricted access or the vetting of persons associated with the service in the interest of security. Services may be subject to confidentiality agreements and service agreements as required.
